A new US Supreme Court order provides immense relief to makers of medical gadgets and in particular cosmetic implants used for breast, buttocks, lip & calf. According to the order, manufacturers are not liable for personal injuries provided the device has been approved by the Food and Drug Administration prior to its launch in the market. It is also imperative that the device meets the FDA specifications.

Highlights of the order
a. This order concerns only those medical devices that were given pre-market approval by the FDA for the market.
b. Most of these products are technologically advanced, expensive and, at times, risky.
c. There have been some implants which are FDA approved, and have led to permanent health problems to patients in the past.
d. However, the order does not foreclose lawsuits that claimed that a device was made in violation of FDA specifications.
